Merujuk pada Bab 480 ayat (1) & ayat (2) Persiapan Kitab Undang-Undang Patokan Pidana (RKUHP) masing-masing 28 Agustus 2019 yang lekas disahkan DPR RI, pelaku perkosaan terhadap sematan dengan sah bisa terkena hukuman kejahatan kurungan menyimpangkan lama 12 tahun bui. Namun, Guru Pedoman Pidana Universitas Trisakti, Abdul Fickar Hajar mengatakan, Perkara 480 pada RKUHP sejatinya menyempurnakan Perkara 285 KUHP tentang perkosaan dengan dikerjakan seorang suami terhadap istrinya dengan belum waktunya buat kawin. Menurut Fickar, munculnya pasal tersebut pula menjadi peringatan untuk pelaku nikah siri biar karet suami tak sewenang-wenang memperlakukan istrinya. Selain tersebut, kata Fickar, pasal tersebut pula menguatkan Pasal 8 huruf (a) Undang-undang Nomor 23 Tahun 2004 akan halnya Penghapusan Kekerasan Di Keluarga (Undang-undang PKDRT). |
